Judge dismisses Patriot Water lawsuit against ODNR

WARREN, Ohio - A judge has dismissed A Warren water treatment plant's lawsuit against the Ohio Department of Natural Resources of intentionally hiding and/or destroying evidence while legal cases were pending related to their EPA permit.

Patriot Water Treatment claims ODNR interfered with or destroyed evidence and disposed specific public records requested between 2009 and 2011.

Patriot claims this hurt their litigation options when the EPA said the city of Warren could no longer accept Patriot's water and forced them out of business for three months.

However, Judge Patrick McGrath ruled that the Court of Claims in Columbus lacked jurisdiction over the public records claim and lawsuit. He also said that the plant should have filed the suit earlier with the Ohio Environment Protection Agency.

In July, the Ohio Environmental Review Appeals Commission ruled the EPA's decision was unlawful.

The company is asking for $3,500,000 in monetary damages and injunctive relief.
