WARREN, Ohio - A convicted child rapist has formal motions in place to seek clemency.

Anthony Mallon, 59, has applied for the clemency and formal commutation from Ohio Governor John Kasich. His application was recently received by the Trumbull County Prosecutor's Office.

Currently, Mallon is serving a 10-25 year prison sentence after taking a plea deal to avoid multiple life sentences in the 1995 case. Mallon plead guilty to three counts of rape and one count of felonious sexual penetration.

"This individual raped a 10-year old child on two separate occasions and this is somebody who took advantage of a child that he knew," said Lu Wayne Annos , Trumbull County Assistant Prosecutor.

Annos says Mallon is not deserving of a break. "This man has proven he's a danger to this community, he's a danger to children and we see no reason to give him a break," she said.

Annos says her office has sent a letter to the Ohio Parole Board opposing any hearing on the matter.
