YOUNGSTOWN, Ohio - The owner of Hardrock Excavating, the company accused of illegally dumping thousands of gallons of waste into a storm drain, has now requested an informal hearing with the Ohio Department of Natural Resources.
Ben Lupo apparently made the request through an attorney according to a ODNR spokesperson.
It was on Wednesday when the ODNR permanently revoked operating permits for two of Lupo's businesses; Hardrock Excavating and D&L Energy.
The hearing will not be open to the public and will be held with ODNR's chief of the oil and gas division.
D&L still has 30 days to file for a hearing with the oil and gas commission or an appropriate court.
