Lupo federally indicted for violating Clean Water Act

CLEVELAND, Ohio - Ben Lupo, owner of D&L Energy and Hardrock Excavating, was indicted by a federal grand jury today for violating the Clean Water Act.

Michael Guesman, 34, of Cortland, and Lupo's company Hardrock Excavating LLC were also indicted, each on one count of violating the Clean Water Act.

Lupo, 62, of Poland, is accused of ordering employees to dump brine wastewater and drilling mud into a sewer drain outside of D&L Energy on Salt Springs Road. The waste eventually made its way to the Mahoning River.

According to the indictment, Lupo ordered Guesman to dump the waste into the sewer drain on several occasions between November 1 and January 31.
