YOUNGSTOWN, Ohio - A Struthers couple faces new charges after a grand jury indicts them in the death of a 14-year-old boy.
A Mahoning County grand jury handed up the indictment against 43-year-old Zaryl Bush and 32-year-old Shain Widdersheim late Thursday afternoon.
The indictment includes two counts of murder against Bush, citing that he purposely caused the death of 14-year-old Teddy Foltz and that the boy's death was caused as a result of being assaulted.
Mahoning County Prosecutor Paul Gains said, "The grand jury found that there's probable cause to believe Mr. Bush beat Teddy Foltz. Basically, beat him unconscious; put him in a coma and a week later he died from his injuries."
Other counts against Bush include involuntary manslaughter, felonious assault and tampering with evidence.
Foltz's mother, 32-year-old Shain Widdersheim had only been charged with child endangering, but is now also indicted on one count of involuntary manslaughter and another for obstructing justice.
"We don't have evidence that she assaulted these children herself, but the evidence strongly suggests that she failed to protect them from Mr. Bush," Gains said.
Between Bush and Widdersheim, they are indicted on 10 counts of child endangering, not only for what happened to Teddy Foltz, but also in regard to his 10-year-old twin brothers.
"That investigation is progressing. They were not charged with beating the other children, but they were charged with child endangering by failing to protect these other two children," Gains said.
Also, where the twin brothers are concerned, Bush is indicted on two counts of intimidation, for threatening the boys, who are witnesses in this case.
Zaryl Bush, had initially been charged with rape, but the grand jury found no evidence to indict him on that charge.
"There was no physical evidence linking Zaryl Bush or anyone else to any sexual conduct with that child," Gains said.
Bush faces 41 years to life in prison. Widdersheim faces 31 years.
