D&L Energy set to appear with ODNR

COLUMBUS, Ohio- A hearing is set between D&L Energy and ODNR in Columbus pending a second hearing in which the company will appeal the revocation of its permits.

Today's hearing will decide whether the natural gas exploration company can continue to operate pending the appeal hearing, which is set for May 22 and May 23.

D&L lost its permits after illegal dumping occurred under its former owner, 62-year old Ben Lupo in February. Lupo admitted to investigators that he instructed an employee, 34-year old Michael Guesman, to illegally discharge thousands of gallons of oil and chemical-based drilling wastewater into a storm drain at his Salt Springs Road facility that drained to the Mahoning River.

Lupo resigned as owner of the company last week, turning ownership over to his wife.
