Ohio Supreme Court weighs woman's death sentence

COLUMBUS, Ohio - The Ohio Supreme Court is deciding to uphold the death sentence of a former Trumbull County woman who plotted her former husband's murder.

The Howland woman was convicted of conspiring with her lover in 2001 to murder her former husband Robert Fingherhut.

Her attorney told the justices today that the judge who re-sentenced Roberts ingored evidence showing their client was mentally ill and suffered brain trauma.

Prosecutors say Roberts made a decision not to enter the evidence in order to receive a death sentence.

"But I'm sure she knew full well what she was going to be in for. She was a middle aged short lady who'd been used to a very pampered and priviledged lifestyle. Which she knew she was not going to have repeated once she was thrown into the general population of a bunch of criminal women who were probably a lot younger than her," said Luwayne Annos, Assistant Trumbull County Prosecutor.
