Mercer County man sues over smoke-free workplace

PITTSBURGH, Penn - A West Middlesex, Pennsylvania man is suing the New Castle Area Transit Authority claiming it violated disability laws by failing to provide a smoke-free workplace.

62-year-old Dale Doutt filed the suit in U.S. District Court claiming that beginning in 2008, he was exposed to second hand smoke at the transit authority, where he was employed as a mechanic.

The suit alleges that the smoke from other workers aggravated Doutt's health problems, which included sinus and high blood pressure.

Doutt also alleges in his suit that he was the subject of retaliation from supervisors after he complained about the smoke.

Transit authority general manager Leonard Lastoria tells 21 News that the building where Doutt works has had no smoking signs posted for the past year. However, Lastoria points out that being a mechanic, Doutt works around  smoke from bus engines all day.

Louis Perrotta, solicitor for the transit authority says that Doutt's complaint with the  Pennsylvania Human Relations Commission was denied. He calls the lawsuit without merit.

Doutt's lawsuit seeks unspecified damages for lost wages, benefits, compensation for personal harm, personal injury, humiliation, embarrassment and loss of self esteem.
