Ohio Libertarians sue over 3rd-party ballot limits

Posted: Updated:

COLUMBUS, Ohio (AP) - Libertarians in political battleground Ohio are challenging the constitutionality of new ballot access rules for minor political parties.

The party argues in a filing Friday in U.S. District Court in Columbus that a bill signed Wednesday by Gov. John Kasich unconstitutionally strips them of a primary.

Capital University law professor Mark R. Brown represents the plaintiffs. He said Friday's complaint relates to a suit filed last month against Ohio's elections chief.

The filing also challenges other aspects of the new law, which established what qualifies as a political party and what percentage of the vote must be won to maintain that status.

The new party rules came as Ohio Republicans face increased competition from tea party supporters who have threatened to back a third-party challenger to Kasich next year.
