Ohio man avoids death penalty in slaying

Posted: Updated:

AKRON, Ohio (AP) - A northeast Ohio man - who was spared a death sentenced when a jury recommended against it - has been sentenced to life in prison.

The Akron Beacon Journal (http://bit.ly/1dfgH4s ) reports that 20-year-old Brian Giles was given a life sentence Wednesday without possibility of parole for more than 62 years.

The same Summit County jury that convicted Giles last month of aggravated murder and other charges had the opportunity to recommend a death sentence but chose life in prison instead.

Giles was convicted of fatally shooting his 27-year-old cousin, Jarrell Cunningham, and wounding 21-year-old Terrell Patterson during a break-in in February 2013.

Police say Giles broke inside his cousin's home, shot the men and stole cash and marijuana before fleeing.
