Youngstown approves severance agreement for Youngstown food inspector

YOUNGSTOWN, Ohio -

The Youngstown Board of Control has approved a severance agreement with former Environmental Health Director Cicero Davis III, who is leaving the job following allegations of dereliction of duty, incompetence, and unprofessional behavior.

Law Director Martin Hume tells 21 News that Davis has volunteered to quit, and will receive the equivalent of three weeks back pay.

In March, Davis agreed to give up his state certificate needed to perform many of his required duties, which included inspecting restaurants and food preparation.

Under a consent agreement, Davis agreed to cease from engaging in any activity that requires a sanitarian registration.

According to an Internal Affairs Investigation conducted by Youngstown police, Davis admitted skipping inspections at Youngstown State University, a nursing home, the Ohio State Penitentiary and other locations in Youngstown's second ward during 2011 and 2012.

Police say signatures were falsified many inspections were not conducted.

In addition, the investigation also turned up pornographic images on the city computer assigned to Davis.

As a result of that investigation, on April 9, 2013 Davis admitted his wrongdoing and signed a last chance agreement with the Youngstown City Health District.

Davis accepted a 60 day suspension without pay, however was allowed to use much of his unused vacation leave. He also agreed not to appeal the discipline and suspension.
