Jury in Youngstown deliberates possible death penalty murder case

YOUNGSTOWN, Ohio - A jury resumed deliberations today in an effort to decide if a Youngstown man is guilty or innocent of allegations that if proven to be true, could result in the death penalty.

Attorneys spent one hour and ten minutes presenting closing arguments Thursday afternoon before the jury got the the case of  Aubrey Toney.

The 33-year-old is accused of firing the shots that killed 74-year-old Thomas Repchic of Youngstown and wounded his wife on Youngstown's south side in September 2010.
Toney has said he was not responsible for the shootings, adding that he was no where near the scene of the crime on the date it occurred.

If convicted, the same jury would be asked if it should recommend that Toney be sentenced to death by lethal injection, or sent to prison.
