Kasich fights subpoena to testify at federal trial

Posted: Updated:
CLEVELAND (AP) - Ohio Gov. John Kasich is fighting a subpoena that would require him to testify for the defense at the federal court trial of a northeast Ohio businessman accused of using employees and others to funnel illegal campaign contributions to two prominent Republican politicians.

A motion filed Monday on Kasich's behalf says attorneys for North Canton telemarketing millionaire Ben Suarez want Kasich to testify that it's not improper for constituents to reach out to elected officials for help.

The motion filed by the Ohio Attorney General's Office says Suarez is not allowed to subpoena Kasich to testify about abstract legal principles just because the testimony would be persuasive.

Kasich spokesman Rob Nichols issued a statement Tuesday saying there's no reason for Suarez's attorneys to seek the governor's testimony.
