Fireworks illegal to use in Ohio; a look at liabilities to homeowners

With the increase of fireworks during the holiday, 21 News spoke to law enforcement and insurance agents about what liabilities you may be taking on when you set them off on your own property.

Remember while you can purchase fireworks in Ohio it is illegal to shoot them off.

Depending on the size of the firework, law enforcement said you can be charged with anything from a misdemeanor to a felony. If you happen to hurt someone, or damage their property while committing the crime, the penalty could be worse.

"You may be getting into the fire marshal coming in and filing charges. And, again after reading the code, you are looking at felonies depending on the seriousness of the crime, if the person and how bad they are hurt or how much damage you actually caused to somebody's property," said Chief Bob Gavalier, Austintown Police Department.

One insurance agent said if you happen to hit your own house with a firework, insurance will likely cover it as long as it was an accident. If you hit your neighbor's house, your liability insurance should also kick in as long as it was an accident. But, of course, policies vary between companies.
