Court denies appeal from man convicted of killing Farrell tavern owner

HARRISBURG, Pa. -

The Pennsylvania Superior Court has denied the appeal of a man convicted of killing tavern owner Billy Basilone and robbing the B&M Market in Farrell.

The court issued separate opinions last week in the case of 20-year-old Joshua Stewart, who is serving two life sentences for murdering Basilone in December 2011.

The judges denied Stewart’s claim that a key ring, used as evidence in the case, was improperly seized by Mercer County jail officials after he was already incarcerated.

The other decision rejected Stewart’s claim that a 10-to-20 year sentence imposed for his part in the robbery of the B&M Market was too harsh.

Just last week, a federal judge placed a ten year prison sentence on top of the two life sentences after Stewart pleaded guilty to violating federal Hobbs Act and Hobbs act robbery laws.

The Hobbs Act prohibits actual or attempted robbery or extortion affecting interstate or foreign commerce.
