Health department axes smoking patio at Cincinnati casino

CINCINNATI (AP) - Cincinnati's downtown casino has run afoul of the city's health department over its smoking patio.

The health department says the patio at the Horseshoe casino, known as The Parlor, doesn't meet its definition of an outdoor patio and should be designated a non-smoking area, according to The Cincinnati Enquirer (http://cin.ci/1MFZxt8).

Horseshoe's owners spent more than $5 million on the 8,800-square-foot patio, which opened last year.

Health department officials say The Parlor is too enclosed to be considered an outdoor patio under Ohio's smoke-free workplace law. The law requires smoking areas to be at least 50 percent open.

Inspectors cited the casino for violating the law, but the casino is fighting to keep the patio open to smokers. It includes a bar, TVs, slot machines and electronic table games.
