Supreme Court won't hear appeal of Niles teen facing murder trial

COLUMBUS, Ohio -

The Ohio Supreme Court has refused to hear an appeal from a Niles teenager accused of killing an elderly neighbor.

The majority of the justices found that the court does not have jurisdiction to hear the appeal filed by Jacob Larosa's attorneys who challenged a decision to put the sixteen-year-old on trial as an adult.

Larosa is charged with the murder of his 94-year old neighbor Marie Belcastro on March 31, 2015.

The defense lost an earlier challenge in the appellate court to overturn the ruling of a juvenile court judge who ruled that the offense should be treated as an adult crime.

Trumbull County Prosecutor Dennis Watkins argued that the lower court's decision is not appealable, and that Larosa should wait until after his trial to file any appeal.

Larosa’s trial is scheduled for September 19
