Canfield, New Castle restaurants prohibited from using Perkins name

A bankruptcy judge has signed an order forbidding ten Perkins restaurant franchises, including those in Canfield and New Castle. from using the Perkins name.

The judge in Pittsburgh approved an agreement allowing 17 other franchises,  including seven here in the Valley, to continue operating under the Perkins banner.

Perkins sought to stop the franchises from using its name, claiming the owner of the franchises owed  Perkins more than $2 million in royalties and other fees.

Before Friday's bankruptcy court order, a federal judge in Tennessee had already issued a temporary restraining order prohibiting the 27 franchises from using any association with the Perkins brand. However, the restaurants, including those in Canfield, Niles, Greenville, Grove City, Hermitage, Warren, Boardman, Austintown, and New Castle, continued business as usual as they continued using the Perkins name.

Just before a hearing was to be held to make the temporary restraining order a more permanent preliminary injunction, franchise owner 5171 Campbells Land Company filed Chapter 11 in bankruptcy court.

It was that case that resulted in the agreement under which 5171 Campbells will agree to cut ties with the Perkins name at the Canfield, New Castle and eight other locations in Ohio and Pennsylvania.

The other eight restaurants that would no longer operate as a Perkins  include Ashtabula, Conneaut, Canton, and Brooklyn, Ohio; as well as Pennsylvania locations in Titusville, Erie West, Cranberry, and Warren (Pennsylvania)

Under the bankruptcy order, the franchises in Niles, Greenville, Grove City, Hermitage, Warren, Boardman, and Austintown could remain in operation as Perkins.
