Two men indicted in Repchic murder could face death penalty

YOUNGSTOWN, Ohio- Two men accused in the drive-by shooting death of a 75-year-old Youngstown man could face the death penalty if convicted.

Kevin Agee and Aubrey Toney were indicted Thursday on charges of aggravated murder with a death penalty specification, attempted murder and felonious assault for the September 25 shootings that killed Thomas Repchic and injured his wife, Jacqueline.

Agee is in police custody, but Toney has still not been located and arrested.
