Suspect in Capitol riot appears before federal judge in Youngstown

A Northeast Ohio man remains in custody after appearing in U.S. District Court in Youngstown on charges stemming from the January 6, 2021, insurrection at the U.S. Capitol.

Andrew Miller of Dundee, Ohio was arrested on Tuesday near his Tuscarawas County home on charges of Entering or Remaining in a Restricted Building or Grounds; Disorderly or Disruptive Conduct in a Restricted Building or Grounds; Disorderly Conduct in a Capitol Building or Grounds; and Parading, Demonstrating, or Picketing in a Capitol Building or Grounds.

According to investigators, Miller went to Washington on January 6 in a passenger van, entering the Capitol through a broken window, which authorities say was the first breach of the building.

Wearing a mask, and goggles, and carrying an American flag, prosecutors say Miller walked into a physical confrontation between a camera crew and an agitated rioter.

According to a court document, Miller allegedly walked through the building, eventually dropping his flag.

As Miller attempted to leave the building, investigators say officers and rioters attempting to enter the building got into a shoving match while Miller stood between them, leading to Miller being shoved.

Shortly thereafter Miller exited the Capitol building by climbing out one of the broken windows, according to the document.

A public defender appointed to represent Miller in court on Tuesday told the Magistrate that Miller refused to speak to him and would not consent to be represented by the attorney.

According to an online court entry, the Magistrate determined that there was a serious risk that Miller would flee, so he remains in the custody of U.S. Marshals until his next hearing on April 9.
