A Hamilton County judge has ruled Ohio's six-week ban on abortion unconstitutional.
According to a press release, the Hamilton County Court of Common Pleas issued a permanent injunction blocking Ohio's six-week abortion ban from taking effect.
This is the first permanent injunction in Ohio stemming from the Reproductive Freedom Amendment, which Ohioans voted to pass in November of 2023.
The case originated in the Hamilton County Court in September of 2022 three months after the ban was put into effect following the overturning of Roe v. Wade in June of 2022.
Jessie Hill, a cooperating attorney for the American Civil Liberties Union (ACLU) of Ohio is quoted in the release saying the six-week ban has "no place" in Ohio's law.
Since the Reproductive Freedom Amendment took effect in December of 2023, abortion providers in Ohio have added claims under the new constitutional right in three additional pending lawsuits challenging various abortion restrictions and have filed one additional new case based on the amendment.
