Malvasi trial delayed over COVID-19 concerns in jury pool

YOUGSTOWN- The Michael G. Malvasi II case, which was set to select a jury trial in Judge Maureen Sweeney's Mahoning County Common Pleas Court, was postponed Monday.
Malvasi, 30, who is accused of aggravated vehicular homicide from 2017, and jury selection was set to take place Monday morning.
However, the jury selection was not able to take place do to health concerns for the safety of the jury pool.
According to Mahoning County Assistant Prosecutor Michael Vacovone, 40 potential jurors had received summons and responded for jury duty. 40 is the current maximum number of jurors that can be called in Mahoning County and allow for state mandated social distancing because of the coronavirus pandemic.
One of the people for jury duty tested positive for COVID-19, one potential juror had symptoms of the virus and was transported for further testing. An additional seven jury poll members provided documentation of awaiting test results for the virus - eliminating 1/4 fourth of the pool selection, making it impossible to select the jury Monday.
Vacovone said the prosecutor's office was surprised and disappointed in the unexpected delay in the case.
Malvasi, of Timber Run Drive in Canfield, is charged in the Nov. 18, 2017, automobile crash on Shields Road in Canfield that killed passenger Ryan Lanzo, 23, of Boardman. He is accused of being the driver of the vehicle and intoxicated at the time of the crash, accused of failing to stop after the accident and tampering with evidence.
Judge Sweeney on Oct. 14 had denied a defense motion to push back the trial date.
According to Mahoning County Jury Commissioner Robert Jackson, the county has no issues seating a jury on the four jury cases held since the courthouse reopened for trials in July.
