POLAND, Ohio -  A licensed physical therapist from Poland is serving a prison sentence in Pennsylvania for insurance fraud.

Fifty-five-year-old Timothy P. Burk was handed a sentence of six months to two years in jail after pleading guilty to one count of insurance fraud last month.

The Cumberland County District Attorney’s Insurance Fraud Division says it began investigating Burk, along with James Mars of Portersville, Pennsylvania three years ago.

The probe involved fraudulent billing practices conducted by Burk Physical Therapy and Rehabilitation which has locations in Elwood City and New Castle PA.

Burk and Mars were arrested and charged one year ago after the investigation revealed that the practice had been fraudulently billing Highmark Insurance for Athletic Training which was being submitted as Physical Therapy services.

Additionally, both men instructed and supervised staff to create false records to support billing of services they knew to be fraudulent, according to the D.A.

The investigation also revealed that Burk Physical Therapy was consistently overbilling for the services that they were legitimately providing, including Aquatic Therapies for patients.

In addition to the sentence which Burk is currently serving at the Cumberland County Prison, he was ordered to pay restitution to Highmark insurance in the amount of $325,000, costs of prosecution, and a $15,000 fine.

Mars plead guilty to misdemeanor receiving stolen property and was sentenced to 12 months’ Probation as well as a $2,500 fine.

Online records show that Burk is still a licensed physical therapist in both Ohio and Pennsylvania with no disciplinary record.
