Mahoning County Deputy Clerk files lawsuit in connection with grocery delivery assault

YOUNGSTOWN Mahoning County Deputy Clerk Jennifer Ciccone has filed a lawsuit in connection with an alleged grocery delivery assault incident from 2023.

According to court records, the lawsuit was filed in the Mahoning County Common Pleas Court July 23, and names Timothy Lucas, as well as grocery store chain Giant Eagle as defendants.

The suit stems from an incident that occurred in July of 2023 where Ciccone said Lucas purposely hit her with his car twice while he was delivering a $500 grocery order from Giant Eagle.

According to the police report, Lucas had asked to see Ciccone's ID since there was alcohol in the order. Police say Ciccone had recently lost her driver's license but offered to provide several other forms of identification that Lucas refused to look at.

Ciccone told police that the confrontation eventually turned hostile with Lucas allegedly refusing to deliver the groceries, but not leaving the property. 

Police say when Lucas did try to leave, Ciccone went behind his car to get his license plate information when Lucas allegedly backed into her, pulled up five feet and backed into her again.

According to the lawsuit, Ciccone's arms, legs and head were injured as a result of this incident.

Lucas was charged with aggravated vehicular assault in connection with the incident. The suit states that Lucas pled guilty and was sentenced to a diversion program.

Ciccone and her husband Daniel Superak are demanding $75,000 in damages, as well as punitive damages, damages for loss of consortium, legal and attorney's fees plus interest in this case.

21 News has reached out to Giant Eagle, who told us they could not comment on pending litigation.
