YOUNGSTOWN, Ohio -  Unless there's a legal resolution to the case, 64-year-old James Ferrara will go on trial Monday for allegedly murdering members of a Canfield family 39 years ago.

That's the word from Mahoning County Common Pleas Judge R. Scott Krichbaum who presided over Ferrara's final pretrial on Tuesday.

The judge said unless the defense attorney and prosecutor come to an agreement in the triple murder case, jury selection will begin next week.

Ferrara is accused of the 1974 murders of Ben Marsh, his wife Marilyn and their 4-year-old daughter Heather.

Fingerprint evidence preserved by the Mahoning County Sheriff's Department for decades -- is now part of the evidence that will be presented against Ferrara. They were able to obtain a hit from a database about 4 years ago...

Ferrara is already serving life in prison for two drug-related murders in Columbus.
