WARREN, Ohio - The man charged with murder during a bungled home burglary in Niles was found not guilty of murder but guilty of involuntary manslaughter.
Michael Burns, 34, was also found guilty of attempted aggravated burglary.
Burns and Terry D. Allen, 36, were trying to break into a home on Niles Cortland Road on July 12th when the home owner, Roy Hahn, used a shotgun to shoot through the door of his home hitting Allen.
Burns attorney told the court his client and four others were trying to take copper from the home not realizing Hahn was inside.
Terry Allen's wife, Nicole Allen, and two others also face a murder charge in the death of their accomplice in crime.
