Youngstown man sentenced for death of baby daughter

YOUNGSTOWN, Ohio -

A man found guilty of involuntary manslaughter in the death of his infant daughter is headed to prison.

Twenty-three-year-old Evan Lee appeared to show little emotion in court Monday as he was sentenced to 8 years in prison for the death of four- month-old Ila Lee.

Judge John Durkin found Lee guilty of involuntary manslaughter and child endangering last week, but he was acquitted of murder and assault.

"The state's experts believe that she died of what's classically called shaken baby syndrome or that the traumatic injuries to her face caused the swelling in her brain... Someone did that," said Judge Durkin.

The charges were filed after authorities determined that the baby died of a head injury in May of 2013.

The prosecutor had recommended the maximum sentence of eleven years, but the judge noted that Lee had no prior criminal record.

Along with the infant's mother, Thomasina Haywood – the victim's maternal grandmother – spoke on behalf of Lee before he was sentenced.

"There was not one part of me that thought he did anything wrong to my daughter. Yes she did pass away. Yes she was in his care. But what more could he have done besides try to save her?" said Haywood.

Lee's family said that he will appeal the sentence.
