Court dismisses appeal by Niles teen murder suspect

WARREN, Ohio -

In a split decision, judges have dismissed an appeal filed in the case of a Niles teenager accused of killing an elderly neighbor.

The 11th District Court of Appeals ruled against the appeal filed by the attorneys representing Jacob Larosa.

The sixteen year old is charged with the murder of his 94-year old neighbor Marie Belcastro on March 31, 2015.

The defense had filed an appeal of a juvenile court decision to have Larosa tried as an adult.  

Appellate judge Cynthia Wescott Rice concurred with the opinion written by Judge Diane Grendell who found that the decision by the juvenile court cannot be appealed until a decision is reached in the case and Larosa is sentenced.

In her dissenting opinion, Judge Colleen O’Toole wrote that, “Waiting until a conviction and sentence are issued by the general division before being able to appeal amounts to the possibility of a lost opportunity and irreparable harm to the child. In dealing with children, the goal should not be about punishing the juvenile but rather it should be about the potential for rehabilitation.”

Larosa’s trial is scheduled for September 19.
