Operators of Warren Township 'recovery house' want suit tossed

Operators of a home for recovering addicts in Warren Township are asking a judge to dismiss a lawsuit filed against them by township trustees.

FSSH holdings filed a motion in Trumbull County Common Pleas court arguing that township efforts to shut down the "recovery house" violate the Federal Fair Housing Act which prohibits discrimination against people with disabilities, which the home's operator argues includes those with drug or other substance addictions.

Trustees argue that because several people stay at the home at 4015 North Leavitt Road, it is in violation of the single-family residential zoning classification in that area.  
 
The township seeks a restraining order, claiming the "recovery housing" use of the property includes transient housing for five to 10 unrelated individuals, typically staying or less than 30 days at the location.

No hearings have been scheduled in the case.
