Family of Warren woman files wrongful death suit against Mercy, others

Posted: Updated:
WARREN, Ohio -

The family of a Warren woman who died last year has filed a wrongful death suit in Trumbull County Court, alleging that Mercy Health, as well as several others, are culpable in her death.

Seventy-four-year-old Artie Williamson died on March 17th, 2018, following a surgical procedure, according to the civil lawsuit.

According to the lawsuit filed by her family, Williamson had gone to St. Joseph's Hospital in Warren on March 10th presenting with "weakness and fatigue."

The suit claims that Williamson was scheduled for an upper endoscopy to check for a gastrointestinal bleed.

The legal filing claims that Williamson was given 80 milligrams of the anesthetic Propofol, and then approximately three minutes later was given another 50 mg of Propofol.

In the filing, the family claims that Williamson's condition declined and she "ultimately suffered a cardiorespiratory arrest." The lawsuit claims that Williamson was resuscitated but had suffered "severe anoxic brain damage."

The filing cites an Illinois doctor that is allegedly an "expert anesthesiologist" as saying that the "beaches of standard of care" contributed to Williamson's death.

The civil lawsuit accuses Mercy Health, Bel-Park Anesthesia, the Gastroenterology Clinic, and Endoscopy Center, and several individual physicians of medical negligence and wrongful death.

Also, the lawsuit accuses Mercy Health of "negligent credentialing."

The family claims that as a result of Williamson's death they incurred medical, hospital, funeral, and burial expenses.

In the filing, the family also states that they have incurred mental anguish from the loss of her "maintenance, society, companionship, consortium, care, assistance, attention, protection, advice, guidance, counsel, instruction, training, education."

The suit asks for a judgment of $25,000 plus punitive damages, attorney fees, and any other relief the court deems appropriate.

According to the U.S. National Library of Medicine, Propofol is commonly used as a general anesthetic.

21 News has reached out to Mercy Health but was told the hospital system could not comment on pending litigation.
