U.S. Marshals and Youngstown police arrested a 29-year-old man who has been indicted for the death of his son after the Mahoning County Coroner ruled the infant's death a homicide. 

Xavier Richardson was indicted by a Mahoning County Grand Jury for one count of aggravated murder, two counts of murder, one count of felonious assault, and one count of domestic violence. 

Richardson was arrested at a residence on Commerce Street in Youngstown on Thursday afternoon. 

Richardson had been charged with murder back in March, but prosecutors withdrew the charges in May saying they wanted to wait until the coroner released his findings in the child's death.

Officers were called to Mercy Hospital to investigate a report that an eight-week-old wasn't breathing and cold to the touch.

They say the child, Xavier Richardson, Jr., had possibly been abused.

The child passed away due to his injuries.

Police say the father told them that the infant was asleep and was gasping for air.
