CLEVELAND, Ohio - A Niles car dealer was sentenced to three years of probation in federal court Friday after pleading guilty to a conspiracy charge. The sentencing of 52-year-old Brian Votino took place before Judge Solomon Oliver, Jr. in the U.S. District Court.

Votino received a sentence that requires him to spend the first 60 days of his probation on home detention with electronic monitoring.

The judgment notes that this location monitoring will begin as soon as possible, but no later than 10 business days after the sentencing.

In addition to home detention, Votino must complete 160 hours of community service within 18 months.

He is also subject to special conditions of probation, which include not using or possessing alcohol, submitting to substance abuse testing, and undergoing a mental health evaluation or treatment.

Two other charges against Votino were dismissed.

The case involved an agreement between Votino and his co-defendant, former Warren assistant prosecutor Nicholas Graham.

Court documents show that in late 2019, Graham allegedly agreed to use his position to help Votino with two pending criminal cases. In exchange for the help, Votino was to provide free repairs to Graham's truck.

Graham, who was previously fired by the city of Warren, is scheduled for sentencing on Wednesday. He has also pleaded guilty to one count of conspiracy. Votino's attorney had cited factors such as good conduct while on bond and health issues in a request for leniency before the sentencing.
