The East Palestine City School District Board of Education has taken the final step to close its federal lawsuit against Norfolk Southern Railway Co. following a settlement agreement.

The board filed a motion in the U.S. District Court for the Northern District of Ohio on Thursday to dismiss the case with prejudice. The legal action means the dispute is resolved and cannot be brought back to court.

The move follows the board’s recent approval of a partial settlement worth $750,000. According to the agreement, Norfolk Southern will pay the district $150,000 to cover the costs of school closures, staff salaries, and transportation during the emergency response to the 2023 train derailment. Another $600,000 is designated for the district’s communication and marketing efforts.

The school district filed the lawsuit last year. Board members argued that the railway company had not fulfilled initial promises to pay for the use of school buildings as emergency centers.

While this specific lawsuit is ending, school officials noted that the settlement does not prevent the district from seeking other claims. Superintendent James Rook previously stated that the district still intends to pursue funding for a proposed $30 million community center and reimbursement for lost tax revenue.

Attorneys for both the school board and Norfolk Southern signed the filing. Each side will pay its own legal fees.
