Plaintiffs in Ursuline lawsuit ask court to dismiss claim, move others

YOUNGSTOWN - A plaintiff in a lawsuit regarding Ursuline High School is asking the court to dismiss a federal claim and move the rest.
This lawsuit was the second one filed against Ursuline late last year, alleging abuse by one of its football players of a female student, filed under the pseudonym Daughter Doe.
The student claims she was allegedly sexually harassed and physically assaulted by a football player between 2023 and 2024.
The claim that the plaintiff in this case is asking the court to dismiss is the Title IX violation, which prohibits sex-based discrimination in an educational environment.
Ursuline continues to maintain the Title IX status because it lacked actual knowledge of the specific harassment until reports were made; therefore, it could not have acted with the deliberate indifference required to prove a civil rights violation.
Additionally, the plaintiff wants the court to move the remaining 14 state claims to the Mahoning County Court of Common Pleas for continued adjudication.
