COLUMBUS, Ohio - Attorneys for a Niles teenager accused of killing an elderly neighbor are asking the Ohio Supreme court to reconsider its decision not to hear their challenge of a ruling that the teen will be tried as an adult for the crime.

Jacob Larosa is charged with the murder of his 94-year old neighbor Marie Belcastro on March 31, 2015.

Last month the justices announced that the court does not have jurisdiction to hear the appeal filed by Larosa's attorneys who challenged a decision to put the sixteen-year-old on trial as an adult, instead of trying the case in juvenile court.

Trumbull County Prosecutor Dennis Watkins successfully argued that the lower court's decision cannot be appealed until after his trial is concluded.

In a motion for reconsideration filed on Friday, Larosa's public defenders make several claims, including that requiring a child to wait until after his trial to appeal is not effective, because as the child grows older, he or she has fewer opportunities to be rehabilitated.

According to online court records, Larosa’s trial is scheduled for September 19.

It is not known if his latest motion will delay that date.
