Austintown Trustees asked to consider liquor permit for hotel restaurant

The operator of an Austintown hotel could get a better idea next week whether or not people will eventually be able to buy and consume liquor inside his business.
The agenda for Monday night's Austintown Trustees meeting includes a pending application from the Fifth Season restaurant for permits to sell beer, wine, mixed beverages as well as Sunday sales.
The permit is not being sought by hotel owner Sebastian Rucci, but Steven James, who operates The Fifth Season restaurant inside the California Palms Hotel and Suites at Route 46 and Interstate 80.
The faux palm tree-lined exterior of the hotel may be more familiar to some under its former name, Hotel California.
Rucci to changed the name of the hotel after the operator of the Hotel California in Santa Monica, California filed a trademark infringement lawsuit in federal court.
Obtaining a liquor license for the new accommodations has been hurdle that Rucci has thus far been unable to surmount.
In February the Ohio Liquor Control Commission issued a four page ruling denying Rucci a license, noting that the hotel and bar is at the same location as a business that demonstrated a disregard for the laws, regulations or local ordinances.
Rucci recently spent thirty days in jail for previous liquor violations that were filed in 2012 when he operated the Go Go Cabaret at the same location as his hotel.
The business opened in April under the Hotel California name without a liquor license, but guests were invited to bring their own liquor.
Rucci has said that the Hotel Palms has been enjoying busy times recently, and is becoming established with the weekend crowd as a place for a mini vacation, and is focusing marketing efforts on the business traveler with long term stays
