According to the indictment Burke was found with a sometime around July 23rd. At that time, Burke was in the Trumbull County Jail for charges related to the death of 22-year-old Kenneth Brandon Sample.

The teen is accused of shooting Sample in the head, and leaving his body in the Grand Wildlife Area in Bristolville a few days after his parents reported him missing on June 12.

Cortland police arrested Burke the morning of June 21 after a robbery at Pizza Joe's the night before and were able to connect him to the murder because of that arrest.
