East Liverpool incinerator pays $288K penalty under clean air settlement

EAST LIVERPOOL, Ohio - A company that operates a hazardous waste incinerator in East Liverpool has settled a complaint made by the U.S. EPA alleging Clean Air Act violations.
Under a consent decree approved by a federal judge, Hermitage Thermal Services will pay a $288,000 civil penalty and has agreed to comply with national air pollution standards at its incinerator on George Street.
The agreement is the result of a complaint filed by the EPA in October 2018 against the facility which stores and processes waste from chemical manufacturing plants, coke by-product plants, and petroleum refineries.
The EPA alleged that the company violated provisions of the National Emission Standards for Hazardous Air Pollutants for hazardous waste combustors, known as Maximum Achievable Control standards, or HWC MACT.
According to the complaint, Heritage didn’t comply with destruction and removal efficiency limits, or with a requirement to send emissions through air pollution control equipment.
Hermitage Thermal admits no wrongdoing according to the consent decree.
