Judge to hear release request from man in prison for beating at Boardman Home Depot
A Youngstown man who has been serving a seven-year prison term since 2018 for a beating that left a man hospitalized for a month will ask a judge for a third time to be released early.
Mahoning County Common Pleas Court Judge John Durkin has previously denied judicial release for 6-year-old Brian Murray in 2020 and 2022.
Judge Durkin has scheduled a judicial release hearing on Thursday for Murray, who was convicted of felonious assault for what prosecutors say was a vicious beating of Gabriel Matthews at the Boardman Home Depot in 2016.
Matthews was hospitalized with traumatic injuries for more than a month.
During the trial, the prosecution called three Home Depot employees to the stand and played surveillance videos of the beating.
Matthew’s wife told 21 News that her husband was in a coma for three weeks.
According to investigators, the attack was over money that Murray claimed Matthews owed him.
If the release is denied, prison records show that he wouldn’t be eligible for release until February 2025.
