The prosecution on Friday filed a response to the defendant's request for discovery of material that attorneys intend to use to prove a pattern of alleged perjury by the three men.


The three men face a total of 83 charges accusing them of lying about an alleged conspiracy with a local businessman to stop Mahoning County Commissioners from purchasing the Oakhill Renaissance Place.


That businessman, who is only identified as Businessman 1, is not mentioned in the original indictment, but the case against the three focuses on their alleged involvement in a lawsuit filed after the Mahoning County Commissioners announced plans to move offices out of a building owned by the Cafaro family.


Nearly all of the discovery material involves conversations that involved attorney Yavorcik between March 1, 2008 and February 5, 2011.


In addition to transcripts of some of Yavorcik's conversation with a cooperating witness, some of the material includes FBI transcripts of recorded conversations between Yavorcik and others, including former Mahoning County Democratic Party Chair, Lisa Antonini, who was sentenced to five months in federal prison for failing to report a campaign donation during her 2008 campaign for county treasurer.


A transcript of a conversation between Yavorcik and an unidentified person that took place at a restaurant on March 1, 2008, centers on raising money for Yavorcik's campaign to run against Mahoning County Prosecutor Paul Gains.


Yavorcik suggests raising funds through a Political Action Committee known as a 527. Not all 527 organizations are required to register with the Federal Elections Commission.


Yavorcik:
But they wanna do a 527P, a PAC.


Speaker:
Oh.


Yavorcik:
I'd rather than just.


Speaker:
Hide it, hide it that way.


Yavorcik:
Yeah, then they can raise as much money as they want from their side first off.


Speaker:
Then nobody will know. Then nobody will know the names.


Yavorcik:
That nobody knows where it came from. I can have no affiliation with it, and then it does just comparison ads, and then they f***ing blast him.


Speaker:
Wow. Yeah. Because they, they can hide big money in there.


Yavorcik:
Yeah. So like if (Businessman 1) wants to give me money, he'll give it to this 527, so it doesn't look like I have any association with (Businessman 1) at all.


Speaker:
That's pretty.... That's genius.


Yavorcik:
So they can raise, you know $50,000, $60,000 in this 527, blast them with media, send it. I mean direct mail.


Speaker: T
hen on the other side you could be doing legitimate fundraising.


Yavorcik:
Legitimate fundraisers are very, you know, polished, spit and polished campaign, positive then they start F***ing nailing him with the 527.


Speaker:
And all the hidden money.


Yavorcik:
And all the hidden money.


A half hour later, according to the transcript, the conversation returned to Businessman 1 and Oakhill Renaissance Place. Oakhill is the building where the county moved it's offices originally located in property owned by the Cafaro Company. The government has concealed the names of some of the names mentioned in the conversation by labeling them as “John Does”.


Yavorcik:
I am close with (Businesman 1).


Speaker:
He has to be excited about this.


Yavorcik:
That I file and that it gets, you know, I think he is, (John Doe 6) talk to him for me. You know, (Businessman 1) is very.. I don't know if you know him. He is very like.. business. All I can say is, like, you know he doesn't really show a lot of emotion. It's just simply, you know by his gestures you know.


Speaker:
Well, Paul (Gains) sure has been mean about their family. I mean, he's made allegations about their parents.


Yavorcik:
(Businessman 1) got f***ing transcripts on Oakhill. That is no lie. (Businessman 1) had it in his office and he showed it to me. He had it in his hands. I know if I can show (Businessman 1) that this guy can be knocked out. What I think I want to do is, if I can get enough money up front, and do a poll. There is enough time. There is nine months till the election. If I can get a poll, a good poll, and show him how to beat f***ing Paul, I will take it right to (Businessman 1) and say look, here is he poll. But here is his vulnerability; Here is how it's going to be. Here is the kind of money I'd like to raise. Can you fund it?


A transcript of a conversation recorded on the eve of the 2008 General Election involved Mike Sciortino, Lisa Antonini, an unidentified speaker and a third person identified as State Rep. 1.


The discussion referred to the expected first indictment in the case. That case was dismissed for lack of evidence.


Sciortino:
When we get out of jail, can we work for the (redacted name) Company?


Speaker:
Huh?


Sciortino:
What do you think I am doing, kidding? Not fun. Tell me about it.


State Rep 1:
Going to grand jury. There is no doubt. Indictment is coming
.


Antonini:
I agree


State Rep. 1:
Prepare yourself. Paul Gains is a maniac.


Friday's discovery filing does not include any transcripts of conversations involving John McNally.


Defense attorneys have been provided with thousands of pages of police reports and summaries associated with the investigation.


Prosecutors say a witness list will be provided when it is finalized.


The next hearing in the case is set for February.
