A Liberty Township man rounded up in an underage sex sting operation now faces a federal charge.
A federal grand jury has handed up an indictment against 36-year-old Andrew Pitts, charging him with enticement.
The indictment says Pitts used a cell phone in an attempt to entice a 12-year-old boy into having sex with him this past February.
Pitts and nine other men were indicted by the Mahoning County Grand Jury in March following their arrests after they allegedly exchanged online messages with undercover agents posing as children as young as 12.
Even though the suspects were talking to undercover agents, the law treats the incidents as if they were speaking to an actual 12-year-old victim.
The federal indictment does not say if the charge stems from the same incident that resulted in the state charges.
The state charges against Pitts included importuning, disseminating matter harmful to juveniles, possessing criminal tools and attempted unlawful sexual conduct with a minor.
According to court records, the county indictment was dismissed on May 5 after it was learned that federal prosecutors were pursuing an indictment against Pitts, who is serving a six-month sentence in the county jail for a probation violation.
