BOARDMAN TWP., Ohio - Prosecutors have asked a judge to drop the charges against a youth flag football coordinator who was arrested in December.
A Mahoning County Judge agreed on Tuesday that there was not enough evidence to prosecute 41-year-old Elliott Giles.
Giles was accused of stealing the device from Panera Bread in December.
Police say the owner of the device noticed it was missing and returned to Panera where he and the manager discovered the alleged theft on video.
According to a police report, Giles told them it was a misunderstanding and that he saw the device on the floor and took it home to try to contact the owner and return it.
All charges have been dismissed.
Giles is the league director of the Youngstown Youth Flag Football Association.
