Howland, Weathersfield hire attorney to fight annexation
TRUMBULL COUNTY, OH - Two Trumbull County townships hire a Cleveland attorney to take on the battle against the proposed Niles annexation plan.
Howland and Weathersfield townships have brought on attorney Robert Zimmerman to investigate the legality of the Niles annexation ordinance, which could require annexation of properties that receive Niles city utilities.
Zimmerman sent a letter to city leaders and county commissioners Saturday morning, asking them to consider the townships' concerns and the legal arguments that they will make if Niles decides to move with annexation.
He's also requested a meeting with the city.
Just this week, county commissioners said they were hoping to bring both sides together to at an economic summit on Feb. 11.
Zimmerman says he and township leaders will attend that meeting.
"We would also welcome a meeting in advance to specifically discuss this letter," Zimmerman said.
Niles city council passed a measure late last year that would mean people and businesses in surrounding communities that use city utilities would be annexed in.
Many in those nearby communities see it as government overreach and a 'land grab' by the city.
Zimmerman is asking the city to adopt legislation staying the implementation of the ordinance.
He claims the city of Niles did not consider prior water and sewer contracts.
"Unless the city rescinds the ordinance, which we understand it will not do (and the townships have not yet demanded), this matter is not going to "go away," Zimmerman states in the letter.
"The townships are prepared to take whatever action is necessary to protect their interests."
