34-year-old Candis Sue Wynn is scheduled to go on trial in Trumbull County for allegedly forcing a three-year-old child to engage in sex acts in late 2018 and early 2019, allowing video to be taken of the alleged acts.
Wynn is most recently charged with three counts of rape and four counts of pandering sexually-oriented material involving a minor. During a recent court appearance, Wynn entered not guilty by reason of insanity plea.
Wynn's defense attorney, Jeffery Goodman, cannot speak specifically on Wynn's case but said generally, a not guilty plea by reason of insanity calls into question what the mental state was at the time of the commission of the offense.
"This is someone who for whatever reason does not have the ability to refrain from engaging in that allegedly criminal conduct," Goodman said.
Goodman explains the person either doesn't understand the wrongfulness of the alleged conduct or understands it, but does not have the mental capacity to refrain from it.
"It's entirely possible for someone who is at trial to be completely sane at that point and not suffering from any psychosis or psychiatric condition," he said, "But they were at the time of the commission of the offense. It may have been a temporary psychotic episode."
Psychiatric evaluations will now be conducted on Wynn to determine her mental state during the alleged rape. Wynn is already serving a 25-year federal sentence on separate child porn charges. If she's found guilty of the most recent charges, she faces life without parole.
