CLARION, Pa - A Mercer County man has been cleared of charges filed in connection with an accident that claimed the lives of two to other men from the county, including a Youngstown State University graduate.
Following a trial in Clarion County this week, a jury deliberated about two hours on Thursday to find 26-year-old Joseph Flynn of Clark, Pennsylvania not guilty of all 23 charges including homicide by vehicle, assault by vehicle, involuntary manslaughter, reckless endangering, and DUI.
State police said Clark was driving a pickup truck that went off the road and struck a culvert and a tree in Clarion County in 2018.
Twenty-nine-year-old Mark Marcucci of West Middlesex died in the crash. Flynn and two passengers were flown to Pittsburgh area hospitals for treatment.
One of those victims, Kevin Yarabinec of Sharpsville, died in the hospital. Yarabinec was a standout pitcher for Sharpsville High School's baseball team and also played baseball for Youngstown State University.
Defense attorney Blair Hindman tells 21 News that Flynn had no recollection of what happened during the crash and that DNA evidence ruled him out as the driver of the truck.
