Lordstown Motors has acknowledged that it is the subject of an investigation by the U.S. Attorney’s office.

In the risk statement contained in a 161-page stock offering prospectus filed with the Securities and Exchange Commission, the Lordstown-based startup electric pickup truck company stated that the U.S. Attorney’s Office for the Southern District of New York is investigating LMC’s merger with DiamondPeak and pre-orders of vehicles.

Media outlets had previously reported the investigations citing sources close to the matter.

LMC also acknowledged the receipt of two subpoenas from the SEC to produce documents and information on the merger and pre-orders.

Former President and CEO Steve Burns and another LMC executive resigned their positions after an in-house investigation by the company found that claims about pre-sales of their Endurance pickup truck may have been inflated.

The prospectus also mentions the six lawsuits filed by investors alleging violations of federal securities laws.

LMC says it is cooperating with the investigations.
