The incident at his home took place on Aug. 29, Pelini turned himself into Boardman police on Aug. 31.
"He's looking forward to trying and regain his family's name and his family's peace," said Attorney Lynn Maro.

multiple injuries.
"When Mr. Pelini could hit record he did. He was in fact assaulted three times, including bite marks, bruises down his arms, scratches across his face."
Maro told the court she was prepared to put into evidence and had prepared a notice of discovery in anticipation of the case going forward, and has listened to the 911 call, 3 voice mail messages, 9 files with text messages, and 15 video recordings from that evening and morning.
"In all the videos there are no injuries to Julie Pelini, but the photos do reflect multiple injuries to Carl. He will testify under oath,"

In the police report it states Julie Pelini remembers a verbal argument, but told one of her children that she didn't know what happened, that Carl yelled at her, she mentioned she bit him on the arm, and told Carl to leave, at which time he screamed at her and kicked a cooler in her direction.
When a judge asked the Assistant Prosecutor whether the evidence Attorney Maro discussed played a role in the state's willingness to drop the criminal charge, he answered yes, and added he has no complaining witness willing to testify against Pelini.
The police report stated both of her children told police their mom had a bleeding black and blue eye.

But her Attorney Kevin Daley, explained Mrs. Pelini never called 911 that her daughter and son did not see what happened, but her daughter being a good daughter saw her mom was hurt and called 911.
Attorney Daley told the court his client will not testify against her husband, and emphasized Julie was trying to stop Pelini from leaving their home after she told him to leave.
"Attorney Daley emphasized, "She is adamant Mr. Pelini never struck her, never intentionally hit her, that it was in the process of trying to grab him out the door that she sustained this injury."
"Even with the dismissal people will continue to judge him and that's wildly unfair and inappropriate. He and his family need to regroup and figure out what is the best path forward for everybody given what's happened," said Attorney Maro.
Assistant Prosecutor Michael McBride said, "She does not want to testify, and there are no other witnesses to the domestic violence, as a result we move to dismiss it. These are two adults. I guess they are going to have to deal with their own circumstances."
Attorney Maro said, "Unfortunately people rush to judgement when they hear these types of allegations without all the evidence,

The Catholic Diocese says its investigation into allegations that coach Pelini became verbally abusive towards members of his team after their loss to Hubbard is continuing, and say the coach is still on paid administrative leave. That means he will not be coaching the Cardinal Mooney Football team in Friday's game.
