A Youngstown woman has filed a wrongful death lawsuit alleging that the City of Youngstown and one of its sanitation workers were negligent, causing the death of her son last year.

Nancy Bish filed the civil complaint last week on behalf of the estate of Brandon Larson, naming the city and Daniel Patrick of Mineral Ridge.

The lawsuit claims that Patrick drove a Youngstown garbage truck into the path of Larson’s dirt bike at Erie Street and Judson Avenue on May 11 of last year.

Larson was thrown from the bike and died from his injuries, according to the suit.

A report filed by city traffic investigators cites “failure to yield” as a circumstance contributing to the crash, saying that the truck stopped at a stop sign before pulling into the intersection.

The report also said that the dirt bike was traveling at an unsafe speed and that testing showed that Larson had a blood alcohol content of .097, as well as cannabinoids, cocaine, and opiates, in his system.

The lawsuit, which seeks unspecified damages for Larson’s two young children, asks the court for a jury trial.

There is no record in Youngstown Municipal Court of Patrick being cited in connection with the accident.
