The FDA issued warning letters to five firms on Wednesday for the illegal marketing of 15 different e-cigarette products. 

Warning letters were issued to Wizman Limited, Shenzen Fumont Technology Co., Shenzen Quawins Technology Co., Ruthless Vapor and Moti Global.

All 15 of these products are packaged to resemble toys, food or cartoon characters, which is likely to promote use by a younger demographic.

None of the manufactures have submitted a premarket application for any of these unauthorized products.

The products described in the warning letter include e-cigarettes that are designed to look like toys such as glow sticks, walkie talkies and Nintendo Game Boy game systems.

Additionally, the products feature characters from cartoons and media that are aimed at a youth and/or teen demographic including The Simpsons, Family Guy, Squid Game, Rick and Morty, Minions and Baby Bus, as well as imitate youth appealing foods such as popsicles.

The letters notified the firms that e-cigarettes without a marketing authorization are adulterated and misbranded, and that distributing these products is prohibited under the Federal Food, Drug & Cosmetic (FD&C) Act.

Failure to correct the violations could result in additional FDA actions such as seizure, injunction and/or civil money penalties. Additionally, products that appear to be misbranded or adulterated offered for import into the U.S. are at risk of being detained or refused admission.
