After more than two years of delays, the back and forth continued Wednesday during the Kimonie Bryant pretrial hearing in the murder case of four-year-old Rowan Sweeney in Struthers on September 21, 2020.

The pretrial was delayed in November awaiting DNA - and were finally obtained - but the results weren't discussed much during the pretrial, briefly mentioned as the prosecution and defense both sought to obtain additional discovery notes from analysts and the lab.

Both 26-year-old Bryant and 19-year-old Brandon Crump are being tried in connection with the Sweeney murder case, however, it was mentioned during Bryant's hearing that Crump would be tried first, followed by Bryant.

The defense attorneys' filed a motion to suppress identification evidence, and asked for Rowan Sweeney's mother, Alexis Schneider, not to identify the shooter in court and the prosecution agreed.

The defense asked to have additional evidence suppressed, while the prosecution argued against it stating there was no basis for an evidentiary hearing and no genuine dispute for the court to resolve.

The judge told both parties they have until January 6 to come up with a stipulation that both parties can agree on, and if not, they would have to have a hearing to settle the matter.

Crump is set to be back in court on Jan. 27 on the aggravated escape and aggravated robbery charges, after additional charges against him were dropped, as Crump was 17 years old at the time. The charges were refiled in juvenile court, including aggravated murder, but he still could be bound over to face charges in D'Apolito's courtroom.
